Overview

These new rules are called the ‘Minerals (other than Atomic and Hydro Carbons Energy Minerals) Concession Amendment Rules’, dated 15th March, 2022. This amendment pertains to the revision made in Rule 45 of the 2016 Rules by making it applicable to other minerals as well and providing a formula for determining the average sale price of glauconite and potash using the price of MOP and percentage of K₂O.

Detailed Description

Minerals (Other than Atomic and Hydro Carbons Energy Minerals) Concession Amendment Rules, 2022, have been framed by the Ministry of Mines in accordance with Section 13 of the Mines and Minerals (Development and Regulation) Act, 1957. These rules amend the existing Minerals (Other than Atomic and Hydro Carbons Energy Minerals) Concession Rules, 2016 with respect to Rule 45 on the determination of Average Sale Price (ASP) of minerals. The rule is expanded to cover other minerals besides Tungsten. Additionally, the amendment provides for a prescribed formula to calculate the Average Sale Price of Glauconite and Potash. The ASP calculation formula for Glauconite and Potash would be based on the domestic price of Muriate of Potash (MOP), as provided by the Department of Fertilizers, Government of India, converted to per ton of K₂O and multiplied by the appropriate factor.
