Detailed Description

The Mineral Concession (Amendment) Rules, 2012, promulgated by the Central Government under the Mines and Minerals (Development and Regulation) Act, 1957, made many changes to the Mineral Concession Rules, 1960 with a special emphasis on tackling illegal mining activities. Under the amendment, the term ‘illegal mining’ was defined to include reconnaissance, prospecting, and mining carried out in contravention of Section 4 of the MMDR Act where no reconnaissance permit or prospecting license or mining lease had been taken. The amendment brought more clarity for the regulatory bodies, including the State Governments, to deal with cases of illegal mining. The amendment also made it easier for one to differentiate illegal mining activities from procedural lapses that may take place within an authorized mining lease area.
